I think there is a rule that members cannot leave and come back on the opposing army.

"Members may not retire or resign from their army and switch to the opposing army during the same war."

3. Illegal Transfers
3.1 Soldiers may not quit or be kicked from an army and join the opposing army during the same war, except in extraneous situations as defined by the Field Marshals.
3.2 Members may not retire or resign from their army and switch to the opposing army during the same war.
3.3 Suspended or banned members may not request a transfer until their suspension or ban expires.
3.4 Someone may not request two transfers within the same war, and must wait until peacetime if they wish to transfer.
